These terms are the agreement between you and Painterner Limited (“we”, “us”), a company registered in Hong Kong at RM.1801 Easey Comm. Bldg., 253-261 Hennessy Road, Wan Chai, Hong Kong. They cover your use of MomoVector at momovector.com, including its website, creation studio and API (the “Service”).
By creating an account, buying credits or otherwise using the Service you accept these terms. If you accept them on behalf of an organisation, you confirm that you are authorised to bind it.
1. What the Service does
MomoVector turns text descriptions, uploaded images and hand-drawn sketches into SVG vector graphics and logos. It sends your input to third-party AI models, which produce intermediate images, and converts the result into a cleaned SVG file that you can download.
The models are operated by third parties, not by us. Requests reach them through a model gateway operated by our group, and the results come back to you through the Service.
2. Your account
You sign in with a Google account. You are responsible for activity under your account and for keeping your Google account secure.
If you create API keys, treat them like passwords: anyone holding a key can spend your credits. You can revoke a key at any time on the developer page.
You must be at least 13 years old, and old enough to form a binding contract where you live.
3. Credits and payment
The Service is paid for with credits, bought in one-time packs. The studio shows how many credits a generation uses before you start it.
- Packs are one-time purchases. Nothing renews automatically and there is no subscription.
- Purchased credits do not expire while your account and the Service remain active.
- If a generation fails, its credits are returned automatically.
- Prices are shown and charged in US dollars.
Payments are processed by Stripe. We never receive or store your card details.
Credit purchases are final. We do not refund unused credits, except where the law requires it, where you were charged in error, or where the Service failed materially and we agree that a refund is due. Write to support@momovector.com if you think one of these applies.
We may change pack prices or the number of credits a generation uses. A change applies to purchases and generations made after it; credits you have already bought are not reduced.
4. Your content and generated works
“Your content” means the prompts, images, sketches and style references you submit, and the SVG files and other output the Service generates for you.
You keep whatever rights you have in your input. As between you and us, you may use the output generated for you for any lawful purpose, including commercial use, to the extent it is capable of being owned. We make no claim to it.
We cannot promise that output is free of third-party rights. AI output can resemble existing works, logos or trademarks, and whether you may use a particular work also depends on the material you supplied and on the model providers’ terms. Check a generated logo or illustration before relying on it commercially, and especially before registering it as a trademark.
You grant us a limited licence to store, transmit and process your content solely to operate the Service for you: to generate and display results, to send your input to model providers, to keep your history, and to investigate failures. We do not use your content to train models, and we do not sell it.
5. Acceptable use
You may not use the Service to:
- upload images or other material you do not have the right to use, or infringe anyone’s copyright, trademark or other rights;
- imitate another business’s logo or brand in a way that could mislead people;
- create content that sexualises minors, incites violence, harasses a person, or is otherwise unlawful;
- attack, overload or probe the Service, access other users’ data, or get around its limits;
- resell access, or run automated workloads outside the published API and its rate limits.
We may suspend or terminate an account that breaches this section, and we will tell you why unless the law prevents it.
6. The API
API use spends the same credits as the website and is subject to the rate and concurrency limits in the API documentation. We may change the API; we will give reasonable notice of changes that break existing integrations.
7. Output quality
Generated works can be inaccurate, incomplete or different from what you asked for. They are provided “as is”, without any warranty of accuracy or fitness for a particular purpose. Review them before you use them.
8. Availability
We aim to keep the Service running but do not promise uninterrupted availability. We depend on third parties, including Cloudflare, Stripe, Google and the model providers, and an outage at any of them can affect the Service. We may change or discontinue features. If we discontinue the Service entirely, we will give reasonable notice so that you can download your works.
9. Termination
You may stop using the Service at any time, and you can ask us to delete your account by writing to support@momovector.com. We may terminate your account for a material breach of these terms.
10. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence.
Subject to that, the Service is provided without warranties of any kind, express or implied. We are not liable for indirect or consequential loss, loss of profit, loss of data, or loss arising from your use of generated works. Our total liability in any twelve-month period is limited to the greater of the amount you paid us in that period and USD 100.
11. Changes to these terms
We may update these terms. For material changes we will give notice on the website or by email at least 30 days before they take effect. If you continue to use the Service after that, you accept the new terms.
12. Governing law
These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction. Either of us may still seek injunctive relief in any court of competent jurisdiction.
